Alphachain Academy – General Terms and Conditions
These Terms and Conditions (the “T&CS”) govern your rights and obligations in connection with the use of services provided by Alphachain Academy Ltd (the “Services”), offered mainly through the www.alphachain.academy website (the “Website”). You are under no obligation to use the Services if you do not agree or understand any portion of these Terms, nor should you use the Services unless you understand and agree to these Terms.
1. Definitions and Interpretation
In this Agreement the following terms shall have the following meanings:
“Content”
means any text, graphics, images, audio, video, software, data compilations and any other form of information capable of being stored in a computer that appears on or forms part of this website;
“Alphachain Academy Limited”
means “Alphachain Academy Limited” / “Alphachain Academy” with registered address 3 Acorn Business Centre, Northarbour Road, Cosham, Portsmouth, Hampshire, PO6 3TH.
“Service”
means collectively any online facilities, tools, services or information that Alphachain Academy makes available through the website either now or in the future;
“System”
means any online communications infrastructure that Alphachain Academy makes available through the website either now or in the future. This includes, but is not limited to, web-based email, message boards, live chat facilities and email links;
“User” / “Users”
means any third party that accesses the website and is not employed by Alphachain Academy and acting in the course of their employment; and
“Website”
means the website that you are currently using www.alphachain.academy, www.alphachainacademy.co.uk, and any sub-domains of this site unless expressly excluded by their own terms and conditions.
2. Introductory Provisions
• By registering on the Website or for Services, where registration is not required, not later than by your first use of the Services, you are entering into a contract with the Provider, the subject of which is the provision of the Services of your choice. The T&C form an integral part of such a contract and, by executing the contract with the Provider, you express your agreement to these T&C.
• The Services are only intended for persons over the age of 18 residing in the country for which the Services are available. By registering on the Website, you confirm that you are over 18 years of age. If you are under 18 years of age, you may not use the Services. You undertake to access the Services solely from one of the countries for which the Services are available. You acknowledge that your access to and use of the Services may be restricted or prohibited by law in some countries, and you undertake to only access and use the Services in accordance with applicable laws.
• The Services consist of the provision of tools for simulated foreign exchange trading on the FX, Commodity and Cryptocurrency market or trading with other instruments on other financial markets, provision of analytical tools, training and educational materials, and other ancillary services, in particular through the Client Section or by provision of access to applications provided by the Provider or third parties. Financial market information is used in the simulated trading; however, you acknowledge that any trading that you perform through the Services is not real. You also acknowledge that the funds provided to you for demo trading are fictitious and that you have no right to possess those fictitious funds beyond the scope of their use within the Services, and in particular that they may not be used for any actual trading and that you are not entitled to the payment of those funds. Unless expressly agreed otherwise, you will not be paid any remuneration or profits based on

THE PROVIDER DOES NOT GIVE OR PROVIDE TO YOU ANY GUIDANCE, INSTRUCTIONS, OR INFORMATION ABOUT HOW OR IN WHICH MANNER YOU SHOULD PERFORM TRANSACTIONS WHEN USING THE SERVICES OR OTHERWISE, OR ANY OTHER SIMILAR INFORMATION ABOUT THE INVESTMENT TOOLS TRADED, NOR DOES THE PROVIDER ACCEPT ANY SUCH GUIDANCE, INSTRUCTIONS, OR INFORMATION FROM YOU. NONE OF THE SERVICES CONSTITUTE INVESTMENT ADVICE OR RECOMMENDATIONS. NO EMPLOYEES, STAFF, OR REPRESENTATIVES OF THE PROVIDER ARE AUTHORIZED TO PROVIDE INVESTMENT ADVICE OR RECOMMENDATIONS. SHOULD ANY INFORMATION OR STATEMENT OF ANY EMPLOYEE, STAFF, OR REPRESENTATIVES OF THE PROVIDER BE INTERPRETED AS INVESTMENT ADVICE OR RECOMMENDATIONS, THE PROVIDER EXPLICITLY DISCLAIMS THAT THE SAME IS INVESTMENT ADVICE OR RECOMMENDATIONS AND SHALL NOT BE RESPONSIBLE FOR THEM.
2. Services
• You can order the Services through the Website or with the HR team by completing the appropriate registration or order form. After registration and final payment, prior to your programme start date we will e-mail you with the details of how to access the services. Those on the Trader Challenge will be emailed the login details for the Client Section and/or Trading Platform and allow you to access them after the initial payment has been made.
• The Services include, among other things, the Funded Trader Programmes, Alphachain Trader Challenge, and Membership products; these products may differ in the scope of the Services provided (e.g., by analytical tools available to the Customer).
• All data that you provide to us through the registration or order form, the Client Section, or otherwise must be complete, true, and up-to-date. You must immediately notify us of any change in your data or update the data in your Client Section. The Customer is responsible for all the provided data being accurate and up-to-date; the Provider is not obligated to verify the data.
• You acknowledge that if you provide an identification number, tax registration number or other similar information in the registration or order form or in the Client Section, or if you state that you are a legal entity, you will be considered as an entrepreneur (trader) for the purposes of these T&CS and when using the Services, and the provisions of these T&CS or the applicable law that grant rights to consumers will not apply to you.
• The fee for the Funded Trader Programmes vary according to the training programme option selected. A non-refundable deposit payment is required to secure a space onto a selected programme. Failure to make payment for the full fee for the Funded Trader Programme will result in the deposit payment being forfeited. Once paid for and a place selected for a given month, the customer is not entitled to a refund. At the company’s discretion, the selected month may be moved to a more suitable time within the next six months.
• The fee for Alphachain Membership is paid monthly for access to services including webinars, slack communications channel, mentoring, and the funded trading account. Failure to make payment for membership on the agreed payment date as per the invoice may will result in all services being withdrawn without notice.
• The fee for the Alphachain Trader Challenge varies according to the option selected and depends on the account size, the degree of the acceptable risk, the parameters that must be fulfilled so that the conditions of the Trader Challenge and the subsequent Verification are met, and possibly other configurations. The fee will be determined based on the option you select when completing the form for ordering the Alphachain Trader Challenge. The Provider reserves the right to also provide the Services under individually agreed conditions. All individually agreed conditions shall be determined by the Provider at its own discretion. Individual discounts and other benefits may not be combined, unless expressly stipulated otherwise by the Provider.
• The fee is paid for allowing you to access the Alphachain Trader Challenge, or the Services provided under the Alphachain Trader Challenge. The Customer is not entitled to a refund of the fee, for example, if the Customer cancels the Customer’s Client Section or requests the cancelation by e-mail, if the Customer terminates the use of the Services prematurely (for example, fails to complete the Alphachain Trader Challenge or the Verification), fails to meet the conditions of the Alphachain Trader Challenge or the Verification, or violates these T&CS.
• If the Customer lodges an unjustifiable complaint regarding the paid fee or disputes the paid fee with the Customer’s bank or payment service provider (e.g. through chargeback services, dispute services, or other similar services), on the basis of which an annulment, cancellation or refund of the fee or any part thereof is requested, the Provider is entitled, at its own discretion, to stop providing to the Customer any services and refuse any future provision of any services.
• Your choice of the option of the Alphachain Trader Challenge that you select when making an order shall also apply to the subsequent Verification. You will start the subsequent Verification and, possibly, other products related thereto, with the parameters and the same currency that correspond to the option of the Alphachain Trader Challenge selected by you. Once you make a selection, it is not possible to change it.
4. Intellectual Property
4.1 All Content included on the website, unless uploaded by users, including, but not limited to, text, graphics, logos, icons, images, sound clips, video clips, data compilations, page layout, underlying code and software is the property of Alphachain Academy, our affiliates or other relevant third parties. By continuing to use the website you acknowledge that such material is protected by applicable United Kingdom and International intellectual property and other relevant laws.
4.2 You may not reproduce, copy, distribute, store or in any other fashion re-use material from the website unless otherwise indicated on the Website or unless given express written permission to do so by Alphachain Academy.
4.3 Material from the website may be re-used without written permission where any of the exceptions detailed in Chapter III of the Copyright Designs and Patents Act 1988 apply.
4.4 Restrictions on Use
You may not use the service for any illegal purpose or in any manner inconsistent with the “T&C”. You agree to use the service solely for your own non-commercial use and benefit, and not for resale or other transfer or disposition to, or use by or for the benefit of, any other person or entity. You agree not to use, transfer, distribute, or dispose of any information contained in the service in any manner that could compete with the business of com. 5. Privacy
5.1 For the purposes of applicable data protection legislation, Alphachain Academy will process any personal data you have provided to it in accordance Privacy Policy available on Alphachain Academy website or on request from Alphachain Academy.
5.2 You agree that, if you have provided Alphachain Academy with personal data relating to a third party (1) you have in place all necessary appropriate consents and notices to enable lawful transfer such personal data to Alphachain Academy and (2) that you have brought to the attention of any such third party the Privacy Notice available on the Alphachain Academy’s website or otherwise provided a copy of it to the third party.
5.3 You agree to indemnify Alphachain Academy in relation to all and any liabilities, penalties, fines, awards or costs arising from your non-compliance with these requirements.

YOU ACKNOWLEDGE THAT THE SERVICES AND OTHER CONTENT ARE PROVIDED “AS IS” WITH ALL THEIR ERRORS, DEFECTS AND SHORTCOMINGS, AND THAT THEIR USE IS AT YOUR SOLE RESPONSIBILITY AND RISK. TO THE MAXIMUM EXTENT PERMITTED BY THE MANDATORY LAWS, THE PROVIDER DISCLAIMS ANY STATUTORY, CONTRACTUAL, EXPRESS AND IMPLIED WARRANTIES OF ANY KIND, INCLUDING ANY WARRANTY OF QUALITY, MERCHANTIBILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFIRNGEMENT OF ANY RIGHTS.

YOU ACKNOWLEDGE THAT ANY TRAINING PROGRAMME OR PRODUCT OFFERED BY ALPHACHAIN DOES NOT GUARANTEE ANY LEVEL OF SUCCESS OR PROFITABILITY. ANY AND ALL INFORMATION ON TRADING PERFORMANCE ON MARKETING MATERIALS, WEBSITE OR OTHER COMMUNICATIONS ARE BASED ON SIMULATIONS AND DOES NOT MEAN THAT SIMILAR PERFORMANCE IS ACHIEVABLE EASILY.
The Provider reserves the right to modify, change, replace, add, or remove any elements and functions of the Services at any time without any compensation.
The Provider is not responsible for its failure to provide the purchased Services if that failure occurs due to serious technical or operational reasons beyond the Provider’s control, in the case of any crisis or imminent crisis, natural disaster, war, insurrection, pandemic, threat to a large number of people or other force majeure events, and/or if the Provider is prevented from providing the Services as a result of any obligations imposed by law or a decision of a public authority
Alphachain Academy makes no warranty or representation that the website will meet your requirements, that it will be of satisfactory quality, that it will befit for a particular purpose, that it will not infringe the rights of third parties, that it will be compatible with all systems, that it will be secure and that all information provided will be accurate. We make no guarantee of any specific results from the use of our services.
No part of this Website is intended to constitute advice and the content of this website should not be relied upon when making any decisions or taking any action of any kind.
The results and targets found on our website and our other literature are based on simulated or hypothetical performance results that have certain inherent limitations. No representation is being made that any account growth or profitability is guaranteed, nor is it guaranteed or extremely likely that profits shown will be achieved. All trades must be within the risk management rules set prior to beginning live trading and could result in trade account contract termination or target extension. Trade accounts have a maximum drawdown of 4%, if reached trade account contract would be terminated. Alphachain Traders are independent contractors with a goal of reaching each target to receive a 50% share of gross profit. You will not receive any basic salary and we will not be responsible for any loss of earnings. The Trader is not liable for their trading losses. Each Trader must seek independent tax liability advice as tax may be due on the trader’s profit.
7. Availability of the Website
7.1 The service is provided “as is” and on an “as available” basis. We give no
warranty that the service will be free of defects and / or faults. To the maximum extent permitted by the law we provide no warranties (express or implied) of fitness for a particular purpose, accuracy of information, compatibility and satisfactory quality.
7.2 Alphachain Academy accepts no liability for any disruption or non-availability of the website resulting from external causes including, but not limited to, ISP equipment failure, host equipment failure, communications network failure, power failure, natural events, acts of war or legal restrictions and censorship.
8. Limitation of Liability
8.1 To the maximum extent permitted by law, Alphachain Academy accepts no liability for any direct or indirect loss or damage, foreseeable or otherwise, including any indirect, consequential, special or exemplary damages arising from the use of the website, any of its services, or any information contained therein. Users should be aware that they use the Website and its content at their own risk.
8.2 Nothing in these terms and conditions excludes or restricts Alphachain
Academy’s liability for death or personal injury resulting from any negligence or fraud on the part of Alphachain Academy.
8.3 Every effort has been made to ensure that these terms and conditions adhere strictly with the relevant provisions of the Unfair Contract Terms Act 1977. However, in the event that any of these terms are found to be unlawful, invalid or otherwise unenforceable, that term is to be deemed severed from these terms and conditions and shall not affect the validity and enforceability of the remaining terms and conditions. This term shall apply only within jurisdictions where a particular term is illegal.
9. No Waiver
9.1 In the event that any party to these Terms and Conditions fails to exercise any right or remedy contained herein, this shall not be construed as a waiver of that right or remedy
10. Previous Terms and Conditions
10.1 In the event of any conflict between these Terms and Conditions and any prior versions thereof, the provisions of these Terms and Conditions shall prevail unless it is expressly stated otherwise.
11. Notices
11.1 All notices / communications shall be given to us by email to info@Alphachain.co.uk. Such notice will be deemed received 3 days after sending if the email is received in full.
12. Law and Jurisdiction
12.1 These terms and conditions and the relationship between you and Alphachain Academy shall be governed by and construed in accordance with the Law of England and Wales and Alphachain Academy and you agree to submit to the exclusive jurisdiction of the Courts of England and Wales.
12.2 We do not accept opening accounts for UAE nationals. This is a requirement as per the laws of UAE and all non UAE brokers/WLs.
13. Use of Website, Services and other Content
13.1 We do not store our clients’ credit or debit card details. All products and services purchased will be delivered in digital form.
13.2 All content on this website and communicated in email correspondence is intended for educational purposes only and AlphachainAcademy.com, Alphachain Academy Limited and its coaches and will not be held responsible for any losses incurred by the client.
13.3 All information provided by AlphachainAcademy.com, Alphachain Academy Limited and/or its contractors is not advice, and the client will trade at their own risk.
13.4 While our trade ideas, from our wider understanding of and experience from trading the financial markets, hold merit, they do not guarantee success or profit, and you should not undertake the act of trading them unless you are fully aware of risk and how to place an order with the broker correctly.

14. Products’ Terms
14.3 Details of an offer will be made available to prospective clients for the trader programmes. The prospective clients are required to complete a “Reservation Form” and pay the full balance of the training fee before receiving access to their product and services.
14.5 The client’s simulated and funded trading account will only be in the name of the client, and Alphachain Academy will not be held liable for any losses on the client’s behalf.
14.7 You have the right to cancel your membership to Alphachain Academy at any time providing a written notice to hr@alphachain.co.uk. Cessation of your subscriptions will terminate access to the membership level and all services.
15. Fair Use Policy
15.3.1 We will always fight chargeback claims. All of the information relating to product fees is clearly visible at multiple stages throughout the purchase process, in addition to our 7-day satisfaction guarantee.
15.3.2 The purchase of any Alphachain Academy products or service is not possible unless the terms and conditions have been explicitly agreed to and accepted by the client before purchase (i.e., without consenting to the terms & conditions, in addition to the associated charges, the purchase will not be possible).
15.3.3 We have all the essential buying information clearly visible to clients, and we robustly defend any chargeback action where the client seeks to claim back the amount spent on the product with their credit card company, under the provision of“unauthorised charge” or “product not as expected”. We deem this to be obtaining our services via deception – an outright abuse.
15.3.4 In the event where a client makes a chargeback claim with their credit card company without contacting Alphachain Academy’s for a resolution beforehand will be in clear breach of our terms and conditions and their actions interpreted as an abuse of service. Regardless of whether the disputed charge is awarded to by the credit card company, the client or Alphachain Academy Limited, we will still view this as an attempt to obtain “paid for” services via deception, and we shall still proactively seek to repatriate the amount owed to us.
15.3.5 Any “chargeback” amount will be pursued by our chosen debt collection company, who will be employed to retrieve the aforementioned sum from the defaulting client. In addition to the fee, we are obligated to pay by the credit card companies in the event of the said chargeback, in addition to a £50 admin fee (the time spent on unnecessary admin) per chargeback claim. The debtor will be liable for any additional legal fees incurred as a result of pursuing any payment which has gone over the standard payment terms.
16. Service Payments & Charges
PLEASE READ ALL OF THE FOLLOWING TERMS AND CONDITIONS OF
SERVICE BEFORE BECOMING A MEMBER AND USING THIS SITE. UPON
ENROLLING, YOU WILL BE GIVEN THE OPPORTUNITY TO VIEW ALL TERMS AND CONDITIONS AND WILL BE INVITED TO ACCEPT OR DECLINE. YOU WILL ONLY BE ABLE TO OBTAIN MEMBERSHIP IF YOU ACCEPT AND AGREE TO ALL TERMS IN THIS DOCUMENT IN ADDITION TO SIGNIFYING THAT YOU UNDERSTAND THE RISKS INVOLVED.
16.1 AlphachainAcademy.com reserves the right at any time to charge or change fees for access to portions of the Service or the Service as a whole. If at any time AlphachainAcademy.com requires a fee for portions of the Service or the Service as a whole, AlphachainAcademy.com will require you to register and create an account.
16.2 In no event will you be charged for access to portions of the service or to the service as a whole unless AlphachainAcademy.com obtains your prior agreement to pay such charges. You shall pay all fees and charges incurred through your account at the rates in effect for the billing period in which such fees and charges are incurred, including but not limited to charges for any products or services offered for sale through the service by AlphachainAcademy.com or by any other vendor or service provider.
16.3 All fees and charges shall be billed to you, and you shall be solely responsible for their payment. You shall pay all applicable taxes relating to the use of the Service through your account, and the purchase of any other products or services. Certain portions of the Service or the Service as a whole may require a prepaid fee (“Prepaid Fee”), which may be modified from time to time in AlphachainAcademy.com sole discretion. You will pay the Prepaid Fee, and all taxes and other fees related to it in advance.
16.4 In no event will you receive any portions of the service or the service as a whole if a prepaid fee is required unless AlphachainAcademy.com receives all fees and charges payable by you, including the Prepaid Fee.
16.5 If we are unable to process payment at the point your monthly subscription falls due; your membership will be barred until we are successfully able to charge your card for the amount due.
16.6 You will no longer have access to the members are or receive member services unless the sum is paid. We will attempt to charge your card once a month on the anniversary date of when you initially enrolled onto the program unless you specify you no longer wish to be a member by writing to us to info@alphachain.co.uk. If your card is successfully debited, your membership and full access rights will first be reinstated immediately.
16.7 Trade signals are only available to all clients depending on their membership level. Some months will have a higher total of trading opportunities than others – in extreme case, some months will have none. We will accept no liability whatsoever for the market conditions and the subsequent lack of opportunities at any given time.
16.8 By continuing to access or use this site, or any service on this site, you signify YOUR ACCEPTANCE OF THESE TERMS AND CONDITIONS OF SERVICE.
AlphachainAcademy.com reserves the right to amend, remove, or add to these terms and conditions at any time. Such modifications shall be effective immediately.
Accordingly, please continue to review these terms and conditions of service whenever accessing or using this site. Your use of the site, or any service on this site, after the posting of modifications to these terms and conditions of service will constitute YOUR ACCEPTANCE OF THE TERMS AND CONDITIONS OF SERVICE, as modified. If at any time, you do not wish to accept the terms and conditions of service, you may not use the site. Any terms and conditions proposed by you which are in addition to or which conflict with these terms and conditions of service are expressly rejected by AlphachainAcademy.com and Alphachain Academy Limited and shall be of no force or effect.
17. Registration and Account Creation
17.1 As part of the registration and account creation process necessary to obtain access to certain portions of the Service, including those portions that require a fee or payment for access, you will select a username and a password. You will provide AlphachainAcademy.com with certain registration information, all of which must be accurate, truthful, and updated.
17.2 You shall not:
17.2.1 select a username already used by another person;
17.2.2 use a username in which another person has rights without such person’s authorisation; or
17.2.3 use a username or password that AlphachainAcademy.com, in its sole
